It’s almost certainly off limits for use in a show. Genuinely the first time I've heard about this. The thing with the Silmarillion is that it was written AFTER the rights for the Hobbit and LOTR were sold to be able to be used in films and such. In fact it was written partially by his son and after his death. The son has absolutely no interest in giving up the rights to it because in his eyes, all of the modern LOTR work is an "absurd" "evisceration" of the books. He's incredibly touchy about it, it seems, so the Silmarillion stuff is likely going to be locked away for a good long while unless they just do it with different names like Shadow of War did.
